What is the Foreign Corrupt Practices Act (FCPA)?

On July 21, 2010, President Obama signed an act that provides big cash rewards to individuals who report violations of the federal securities or commodities laws including the Foreign Corrupt Practices Act (FCPA) to the U.S. Securities and Exchange Commission (SEC). Under the Dodd Frank Wall Street Reform and Consumer Protection Act, (link to client alert) whistleblowers can earn a bounty or reward of at least 10 % and up to 30 % of the monetary sanctions over $1 million for reporting misconduct – such as insider trading, money laundering, bribery and other violations of the FCPA – by employers and competitors. 

Whistleblower Rewards

Rewards to whistleblowers range from 10 % to 30% of the money collected by U.S. government agencies based on the information that is provided.

Obtaining Whistleblower Protections

The new FCPA law prohibits retaliation against whistleblowers. Employers cannot fire, harass, threaten or discriminate against those who provide information to the U.S. government. Engaging counsel allows a whistleblower to anonymously report fraud or other wrongdoing under this new law.
